Website asks high court to throw out lawsuit

A lawyer told the Washington Supreme Court on Tuesday that a lawsuit filed by three young girls who were sold as prostitutes on a website should be thrown out because the website didn't write the ads, so it's not liable.
But the victims' lawyer said the website, Backpage, doesn't have immunity under the federal Communications Decency Act because the website markets itself as a place to sell "escort services" and provides pimps with instructions on how to write an ad that works, making them a participant in the largest human-trafficking website in the U.S.
The justices plan to rule on the case at a later date.
Before the hearing several dozen people stood in the rain on the court steps with signs that read: "People's bodies are not commodities," ''End Child Slavery" and "Stop Buying Our Girls."
"No one has the right to sell a kid for sex," said Jo Lembo, with Shared Hope International. "That's why we're here. Someone has to speak up for them. They're kids."
A similar case was filed last week in federal court in Boston, but a previous case in Missouri was dismissed, said Yiota Souras, a lawyer with the National Center for Missing & Exploited Children. "The Washington state case has gone further than any previous case," she said. |

Appeals court reinstates Texas voter ID law

A federal appeals court on Tuesday temporarily reinstated Texas' tough voter ID law, which the U.S. Justice Department had condemned as the state's latest means of suppressing minority voter turnout.
The ruling by a three-judge panel of the New Orleans-based 5th Circuit Court of Appeals allows the law to be used in the November election, despite a lower judge's ruling that the law is unconstitutional. The 5th Circuit did not rule on the law's merits; instead, it determined it's too late to change the rules for the election.
The judge said the Supreme Court has repeatedly told courts to be cautious about late-hour interruptions of elections. Early voting starts Oct. 20.
"It will be extremely difficult, if not impossible, for the state to adequately train its 25,000 polling workers at 8,000 polling places" in time for the start of early voting, the appeals court wrote.
While some voters may be harmed, the greater harm would come in potentially disrupting an election statewide, the court said. |

Supreme Court rejects appeal over Justice memo

The Supreme Court won't hear an appeal from a civil liberties group that wants to make public an internal Justice Department memo that allows the FBI to informally obtain phone records.
The justices on Tuesday let stand an appeals court ruling that said the Justice Department could refuse to release the 2010 memo under an exception to the Freedom of Information Act.
The Electronic Frontier Foundation argued that the public has a right to see how the Justice Department's Office of Legal Counsel authorized the FBI to access phone call records from telephone companies for terrorism investigations.
The U.S. Court of Appeals for the District of Columbia Circuit said the memo was part of the government's internal deliberations and therefore exempt from disclosure. |

Texas appeals court upholds DeLay reversal

The highest criminal court in Texas has refused to reinstate two money-laundering convictions of former U.S. House Majority Leader Tom DeLay.
The Texas Court of Criminal Appeals on Wednesday upheld a ruling last year from the 3rd Court of Appeals that tossed DeLay's 2010 convictions for money laundering and conspiracy to commit money laundering.
Prosecutors argued in June before the Austin-based Court of Criminal Appeals that the convictions be reinstated.
But the appeals court said in its 8-1 ruling it agrees with the lower court findings, which said as a matter of law, what prosecutors proved in DeLay's case did not constitute either offense.
The charges were related to corporate donations to DeLay's political action committee that prosecutors say were illegally funneled to some Texas House candidates in 2002.
