Court to hear dispute over state tax collection

The Supreme Court on Tuesday agreed to consider a dispute over how a state may tax the income that its residents earn in another state.

In a case that could affect how taxes are collected in every state, the justices will hear an appeal from Maryland officials who want to overturn a lower court ruling that found the state's tax law unconstitutional.

Maryland law allows residents to deduct income taxes paid to other states from their Maryland state tax. But it does not apply that deduction when it comes to a local "piggyback tax" the state collects for counties and some city governments.

Last year, the Maryland Court of Appeals said the tax violates the Constitution's Commerce Clause. The court said the law discourages Maryland residents from earning money outside the state.

Maryland Attorney General Douglas Gansler says the state has authority to tax all income of its residents, even income earned outside the state. He said the Court of Appeals' decision could cost local governments $45 million to $50 million annually and warned that Maryland might have to refund up to $120 million in taxes.


Turkish court orders arrest of Israeli commanders

A Turkish court on Monday ordered the arrests of four former Israeli military commanders being tried in absentia over the killing of nine people aboard a Turkish aid ship that tried to break a Gaza blockade in 2010, Turkey's state-run news agency reported.

The court in Istanbul ruled that authorities must seek an international warrant for Israel's former military chief Lt. Gen. Gabi Ashkenazi and three other former commanders, the Anadolu Agency reported. Trial was then adjourned until Dec. 9.

Turkish prosecutors are seeking life in prison for the officers. It was unlikely however, that Israel would ever extradite the four to Turkey.

The court's decision, meanwhile, comes despite signs that Turkey and Israel could be close to ending a four-year rift over the deaths.

Turkish officials have said that the two countries are close to sealing a reconciliation pact, while in March, Israel agreed to ease its blockade to allow building materials into the Gaza Strip for the construction of a Turkish hospital.

The reconciliation deal would lead to compensation for the families of the victims and for court cases against Israel over the raid to be dropped.

Federal court upholds California water transfer

A federal appeals court says environmental reviews were properly done on the nation's largest farm-to-city water transfer, the latest ruling to uphold a 2003 agreement on how California agencies divide that state's share of Colorado River water.

A three- judge panel of the 9th U.S. Circuit Court of Appeals ruled Monday that federal authorities properly considered how the transfer from Imperial County to San Diego would affect the Salton Sea, California's largest lake. The shrinking lake relies on water runoff from Imperial Valley farms.

The ruling upholds a decision by U.S. District Judge Anthony Battaglia in San Diego. Imperial County and the Imperial County Air Pollution Control sued in 2009, alleging violations of the National Environmental Policy Act.
