Appeals court sides with Alaska on roadless rule

A divided federal appeals court panel on Wednesday sided with the state of Alaska in reversing a decision that reinstated prohibitions on road-building and the harvesting of timber in the nation's largest national forest.

A three-judge panel of the 9th U.S. Circuit Court of Appeals, in a 2-1 decision, found that the U.S. Department of Agriculture had articulated "a number of legitimate grounds" in a 2003 decision to temporarily exempt the Tongass National Forest in southeast Alaska from the Roadless Rule, which contains the prohibitions.

A lower court judge, in 2011, had found the decision to be arbitrary and capricious.

The appeals court panel sent the matter back to the district court to determine whether additional environmental review is required. Ninth Circuit Court Judge M. Margaret McKeown dissented, saying the justification for the overturning the lower court's decision was missing.

California court: Drivers can read cellphone maps

Drivers in California can legally read a map on their hand-held cellphones while behind the wheel, a state appeals court ruled Thursday.

The 5th District Court of Appeal reversed the case of a Fresno man who was ticketed in January 2012 for looking at a map on his iPhone 4 while stuck in traffic. The driver, Steven Spriggs, challenged the $165 fine.

But Spriggs said he's no champion of those who think they can get away with cruising down the road while staring at their phone or engaging in other such dangerous behavior. Spriggs would like the law that ensnared him to be rewritten so officers can do their job unencumbered.

"We're distracted all the time," he said. "If our distractions cause us to drive erratically, we should be arrested for driving erratically."

It's personal for Spriggs, whose son suffered a broken leg from a driver who was chatting on a cellphone. Spriggs said he uses a hands-free device to talk and drive.

The incident that ensnared Spriggs happened when he was stopped by roadwork. He had grabbed his cellphone to find an alternate route when a California Highway Patrol officer on a motorcycle spotted him and wrote the ticket.

Spriggs first challenged the case in traffic court, where he lost, and then appealed it himself to a three-judge panel in Fresno County Superior Court, where he lost a second time.



Argentina asks top US Court to stop 'catastrophe'

Argentina filed a long-shot appeal to the U.S. Supreme Court on Tuesday asking the justices in Washington to avert an "economic catastrophe" by overturning lower court rulings that could force the South American government to default on billions of dollars in debts.

Making Argentina pay cash in full to investors who didn't accept bond swaps in exchange for defaulted debt could destabilize the global economy by making other voluntary debt restructurings "substantially more difficult, if not impossible," the petition said.

"Full payment of the holdouts would cut Argentina's reserves approximately in half, an unimaginable result for any nation," Argentina's lawyers argued. "Any sovereign would protest if a foreign court issued an extraterritorial order threatening its creditors and citizens and coercing it into turning over billions of dollars from its immune reserves."

By ignoring the federal sovereign immunity law that normally protects other countries' assets from seizure outside the United States, the lower court decisions also could make U.S. assets overseas vulnerable to similar seizures by other governments, the petition said.
