Sen. Menendez enters not guilty plea to a new conspiracy charge

U.S. Sen. Bob Menendez returned to Manhattan federal court Monday to challenge a new criminal charge alleging that he conspired to act as an agent of the Egyptian government when he chaired the Senate Foreign Relations Committee.
“Not guilty,” Menendez, 69, said when Judge Sidney H. Stein asked him for a plea to the charge. It was his first appearance before Stein, who is expected to preside over a trial tentatively scheduled for May.
Stein said the plea was the sole purpose for the hearing and adjourned the proceeding after less than five minutes. The New Jersey Democrat left the courthouse minutes later without speaking to reporters waiting outside. At an arraignment before a magistrate judge last month, Menendez was released on a $100,000 bond.
In a statement issued after the hearing, Menendez repeated his claim that the new charge “flies in the face of my long record of standing up for human rights and democracy in Egypt and in challenging leaders of that country.”
He again called it “as outrageous as it is absurd” and said he has been loyal only to the United States his entire life.
“The facts haven’t changed. The government is engaged in primitive hunting, by which the predator chases its prey until it’s exhausted and then kills it. This tactic won’t work,” he said. “I will not litigate this case through the press, but have made it abundantly clear that I have done nothing wrong and once all the facts are presented will be found innocent.”
Menendez was forced to step down from his powerful post leading the Senate committee after he was charged last month. Prosecutors said the senator and his wife, Nadine Menendez, accepted bribes of cash, gold bars and a luxury car over the past five years from three New Jersey businessmen in exchange for a variety of corrupt acts.
The other defendants entered not guilty charges to a superseding indictment last week. The senator was permitted to delay his arraignment so he could tend to Senate duties. He has said that throughout his life he has been loyal to the United States and that he will prove he is innocent. |

The Supreme Court on Monday ordered two internet sellers of gun parts to comply with a Biden administration regulation aimed at ghost guns, firearms that are difficult to trace because they lack serial numbers.
The court had intervened once before, by a 5-4 vote in August, to keep the regulation in effect after it had been invalidated by a lower court. No justice dissented publicly from Monday’s order, which followed a ruling from a federal judge in Texas that exempted the two companies, Blackhawk Manufacturing Group and Defense Distributed, from having to abide by the regulation of ghost gun kits.
Other makers of gun parts also had been seeking similar court orders, the administration told the Supreme Court in a filing.
“Absent relief from this Court, therefore, untraceable ghost guns will remain widely available to anyone with a computer and a credit card — no background check required,” Solicitor General Elizabeth Prelogar, the administration’s top Supreme Court lawyer, wrote.
The regulation changed the definition of a firearm under federal law to include unfinished parts, like the frame of a handgun or the receiver of a long gun, so they can be tracked more easily. Those parts must be licensed and include serial numbers. Manufacturers must also run background checks before a sale - as they do with other commercially made firearms.
The requirement applies regardless of how the firearm was made, meaning it includes ghost guns made from individual parts or kits or by 3D printers.
The regulation will be in effect while the administration appeals the judge’s ruling to the 5th U.S. Circuit Court of Appeals in New Orleans — and potentially the Supreme Court. |

Rep. George Santos’ former campaign treasurer will plead guilty to a federal felony

The ex-campaign treasurer for U.S. Rep. George Santos is scheduled to enter a guilty plea to an unspecified felony in connection with the sprawling federal investigation of financial irregularities surrounding the indicted New York Republican, prosecutors say.
Nancy Marks is a veteran Long Island political operative. Marks served as the campaign treasurer and close aide to Santos during his two congressional bids. Marks resigned amid growing questions about Santos’ campaign finances and revelations Santos had fabricated much of his life story.
Marks’ plea is scheduled to take place in a Central Islip courtroom on Thursday afternoon. It comes as Santos faces a 13-count federal indictment centered on charges of money laundering and lying to Congress in an earlier financial disclosure.
The investigation of the first-term congressman has also engulfed Marks, a key behind-the-scenes figure in Long Island Republican politics who built a business as a treasurer and consultant to dozens of local, state and federal candidates.
Marks has faced questions about the congressman’s unusual campaign filings, including a series of $199.99 expenses, just below the legal limit for disclosure. Santos, in turn, has sought to pin the blame for his unexplained finances on Marks, who he claims “went rogue” without his knowledge.
Any deal with prosecutors that requires Marks to testify in the case against Santos could be a severe blow to the Republican, who faces charges that he embezzled money from his campaign, lied in financial disclosures submitted to Congress and received unemployment funds when he wasn’t eligible.
While Santos has admitted fabricating key parts about his purported background as a wealthy, well-educated businessman, questions remain about what he did for work, as well as the true source of more than $700,000 he initially claimed to have loaned his campaign from his own personal fortune.
Santos has pleaded not guilty to charges he duped donors, stole from his campaign and lied to Congress about being a millionaire, all while cheating to collect unemployment benefits he didn’t deserve. He has defied calls to resign.
A formal complaint filed by the Campaign Legal Center with the Federal Election Committee alleges that unknown groups may have illegally funneled money into the Santos campaign. The complaint, filed last January, named Marks along with Santos. |

Progressive Councilmember Freddie O’Connell wins Nashville mayor’s race

Freddie O’Connell, a progressive member of Nashville’s metro council, has resoundingly won the race to become the next mayor of the Democratic-leaning city, according to unofficial results.
Results from the Davidson County Election Commission show O’Connell defeated conservative candidate Alice Rolli in Thursday’s runoff election by a wide margin, with all precincts reporting. Candidates in the race do not run with party affiliations.
Since 2015, O’Connell has served on the combined city-county government’s council, representing a district that covers downtown Nashville. He succeeds Mayor John Cooper, who decided not to seek reelection.
O’Connell, whose campaign touted him as the “only truly progressive candidate running for mayor,” said he wants to make the city “more ’ville and less Vegas,” a reference to the “Nashvegas” moniker sometimes used to liken the huge boom in tourism in the city to Las Vegas.
“Every part of this city deserves the public resources that bind neighborhoods and neighbors together — schools, parks and libraries,” O’Connell said in a victory speech. “And when we do that, our interactions with our local government should leave us feeling satisfied that a real person worked to solve our issue.”
Down the ballot, Olivia Hill won an at-large metro council seat to make history as the first transgender candidate to be elected to office in Tennessee, according to the LGBTQ+ Victory Fund. Hill’s victory stands in contrast to Tennessee’s Republican leadership in state government, where lawmakers have passed a series of restrictions on the rights of transgender people. |

McCarthy juggles a government shutdown and a Biden impeachment inquiry

House Speaker Kevin McCarthy is a man who stays in motion — enthusiastically greeting tourists at the Capitol, dashing overseas last week to the G7 summit of industrial world leaders, and raising funds back home to elect fellow Republicans to the House majority.
But beneath the whirlwind of activity is a stubborn standstill, an imbalance of power between the far-right Republicans who hoisted McCarthy to the speaker’s role yet threaten his own ability to lead the House.
It’s a political standoff that will be tested anew as the House returns this week from a long summer recess and McCarthy faces a collision course of difficult challenges — seeking to avoid a government shutdown, support Ukraine in the war and launch an impeachment inquiry into President Joe Biden.
“They’ve got some really heavy lifting ahead,” said the No. 2 Republican in the Senate, John Thune, of South Dakota.
McCarthy, of California, is going to “have his hands full trying to figure out how to navigate and execute,” he said.
Congress has been here before, as has McCarthy in his nearly two decades in office, but the stakes are ever higher, with Republicans powered by an increasingly hard-right faction that is refusing to allow business as usual in Washington.
With former President Donald Trump’s backing, McCarthy’s right-flank pushed him into the speaker’s office at the start of the year only after he agreed to a long list of conservative demands — including the ability to call a quick vote to “vacate the chair” and remove him from office.
That threat of an abrupt ouster hovers over McCarthy’s every move, especially now.
To start, Congress faces a deadline to fund the government by the end of the month, or risk a potentially devastating federal shutdown. There are just 11 working days for Congress to act once the House resumes Tuesday.
McCarthy and his team are pitching lawmakers on a stopgap funding bill, through Nov. 1, to keep the government running under a 30-day continuing resolution, or CR, according to a leadership aide granted anonymity to discuss the private talks.
But as McCarthy convenes lawmakers for a private huddle, even the temporary funding is expected to run into opposition from his right flank.
Facing a backlash from conservatives who want to slash government funding, McCarthy may be able to ease the way by turning to another hard-right priority, launching a Biden impeachment inquiry over the business dealings of the president’s son, Hunter Biden. |
