Labor lawyer: Kansas union bill will silence workers

A labor attorney and the Kansas Senate president sparred Tuesday over whether public employees have a right to have money deducted from their paychecks for union-backed political activities.

Rebecca Proctor and Senate President Susan Wagle clashed during a Senate Commerce Committee meeting over a bill that would bar automatic, voluntary deductions from teachers and government workers' paychecks to support union-backed political activities, such as campaign contributions. The measure passed the House on Thursday.

Wagle said many Kansas residents don't agree with public unions' or teachers' positions on issues and the state should not be involved in channeling money to support those views. Supporters of the bill say union members often feel bullied or coerced to make the automatic contributions for fear of alienation or retribution in the workplace.

Proctor said public workers have a right to use their pay as they wish. She also said she believed the bill could go so far as to prevent unions from advocating for particular values or issues that are not partisan but are ideological, such as testifying before the Legislature on worker safety or education.


Lawyer questions memory of Philadelphia accuser

A longtime heroin addict whose complaint helped imprison a Philadelphia archdiocese official came under attack Wednesday, as jurors in a priest-abuse trial learned that he had given three different locations for one alleged rape.

Defense lawyers questioning the gaunt, 24-year-old policeman's son poked several holes in his accounts, some of which he attributed to years of heavy drug use.

The man said he as "semi-comatose ... but standing" when he first spoke with a church investigator in 2009.

The witness, with prompting from a counselor, had called the archdiocese from a drug clinic, ultimately reporting that two Roman Catholic priests and ex-teacher Bernard Shero had sexually assaulted him in about 1999.

Shero, 49, of Levittown, and the Rev. Charles Engelhardt, 66, of Wyndmoor, are on trial, fighting the charges. Now-defrocked priest Edward Avery is in prison after pleading guilty.

During cross-examination Wednesday, Shero's lawyer said the accuser has said over the years that the teacher raped him in his sixth-grade classroom, near a trash bin outside an apartment complex and in the parking lot of a city park.

The accuser explained that he was high when he spoke to the church investigator in a car outside his parents' house, and doesn't remember much of the conversation. His drug habit at times reached 15 to 20 bags of heroin a day, the young man acknowledged.



UK court sides with Samsung in Apple suit

Britain's Court of Appeal has backed a judgment that Samsung's Galaxy
tablet computer is "not as cool" as Apple's iPad — and therefore
doesn't infringe Apple's rights.

The panel's upholding of the findings of by a lower court endorses the
U.K. judgment which made headlines around the world when it was handed
down in July. Judge Colin Birss had then gushed over Apple's design,
while knocking back the company's case against its rival.

"The extreme simplicity of the Apple design is striking," Birss wrote
at the time, enthusing over its "undecorated flat surfaces," its "very
thin rim" and "crisp edge."

"It is an understated, smooth and simple product," Birss wrote, saying
that Samsung's products "are not as cool."

On Thursday, the Court of Appeal agreed unanimously with Birss, with
Judge Robin Jacob ordering Apple to publicize the court rulings to
make sure consumers knew that Samsung wasn't a copycat.

"The acknowledgement must come from the horse's mouth," Jacob said.
"Nothing short of that will be sure to do the job completely."

Kim Walker, a partner with English law firm Thomas Eggar LLP, said
that the ruling was an endorsement of Samsung's originality — if not
its design.

"It appears that you don't have to be cool to be original when it
comes to intellectual property rights," she wrote in an email. "You
just have to be different!"

The British case is just one of several in Apple and Samsung's
international copyright battle, which has raged across Europe and the
United States.


Feds seek full court review of cigarette warnings

The U.S. government is asking a federal appeals court to rehear a challenge to a Food and Drug Administration requirement that tobacco companies to put large graphic health warnings on cigarette packages to show that smoking can disfigure and even kill people.

The Justice Department filed a petition Tuesday asking for the full court to rehear the case after a three-judge panel of the U.S. Court of Appeals in Washington affirmed in August a lower court ruling blocking the mandate, saying it ran afoul of the First Amendment's free speech protections. However, the court rarely grants such appeals.

Some of the nation's largest tobacco companies, including R.J. Reynolds Tobacco Co., sued to block the mandate to include warnings to show the dangers of smoking and encouraging smokers to quit lighting up. They argued that the proposed warnings went beyond factual information into anti-smoking advocacy. The government argued the photos of dead and diseased smokers are factual.



High court won't stop Texas voting map

The Supreme Court is allowing Texas to use congressional districts that were drawn by a lower federal court for the November election.

The court declined without comment Wednesday a request from a Latino rights group to block use of those districts. The groups said the districts discriminate against minorities.

The court-drawn map is intended for use only in this year's election.

The League of United Latin American Citizens said the map has the same flaws identified by federal judges in Washington who last month rejected political boundaries drawn by Texas lawmakers as discriminatory.

The interim congressional map was used in Texas' primaries in May and was devised to let the state hold elections while courts considered challenges to redistricting plans adopted by the Legislature following the 2010 census.
